Utah Vape Shops Sue Health Department over Flavored e-cigarette ban

Recently, many vape shops in Utah has filed a law suit against the health department for restricting the sales of flavored e-cigarettes in the state. This complaint was filed on Monday which is noted to be the day the ban was effected in the 3rd District Court in Salt Lake City, Utah. Udoh on the 3rd of October announced a new emergency rule which was about the banning of general tobacco retailers from selling flavored e-cigarettes. The vape shops are however eligible to sell non flavored e-cigarettes.

This rule exempted special tobacco stores who were given eligibility to sell the products. While the retailers are requested to post public notices regarding the dangers of vaping unregulated thc vape brands. After a thé drastic outbreak of lung illness as a result of flavored e-cigarettes, there came a decision resulting to its ban.The number of damages caused by this vaping products was reported by the Utah Health department to be more than 98, while a total of about 15 cases are still ongoing investigation. So far this said result, only 1 person has been reported death from vaping in Utah. Udoh reported that this individual died as a result of vaping thc .

It is also noted that the US officials has registered about 1500 cases and 33 deaths as a result to vaping nationwide. Upon all this reports, the lawsuit submitted by the vape shops in Utah claimed that there’s no evidence proving that flavored e-cigarettes caused the lung illness and damage. And that the Udoh investigation results does not link the lung disease to the flavored e-cigarettes products but instead links the illness to the person consuming black market thc vape cartridges.

The report from the Health Official states that  94% of people were surveyed vaping the thc vape cartridges while only 2 were out of 36 people were found smoking nicotine products that had no thc component The lawsuit  also made mentioned that the health department is currently aware about vaping of youths /adults since the early 2011 and there no grounds to declare an emergency. A judge is expected to make a ruling Friday. The complaint was filed against the UDOH and Joseph Miner, the organization’s executive director.
